HOA Bill Advances in the Legislature [GEORGIA]
By Tammy Joyner published by State Affairs
March 28, 2024
"Bills geared to addressing challenges facing homeowners’ associations and the residents who live in such community-governed places have advanced in the Georgia Legislature — but not without some bipartisan wrangling."
NOTE WITH REGARD TO HB 220: Joyner mentions that HB 220 requires notice to residence of violations, but what the article does not mention is the language following that which, to my understanding, essentially overrides Senator James's work at that time to require mediation. The language is "the association may pursue injunctive relief without the need or requirement to first pursue or utilize any other remedies, regardless of whether other remedies may be available or might otherwise be adequate ..." I welcome your thoughts and clarification. You can find the text of the full bill HERE.
